Provider<\/strong>\u00a0\u2013\u00a0MOTOSHARE.ro (hereinafter referred to as the "Website") <\/span>, the rental services provider represented by SC LAREDO SRL CUI 14980346 with headquarters in Cluj-Napoca, ROMANIA<\/p>

Client<\/strong>\u00a0\u2013 any natural or legal person who accesses the website and\/or enters into a motorcycle rental agreement.<\/p>

Owner<\/strong> \u2013 the owner of the motorcycle, natural or legal person, listed on the motoshare.ro website offered for rent.<\/p>

Motorcycle<\/strong>\u00a0\u2013 any vehicle offered for rent through the website.<\/p>

Rental Agreement<\/strong><\/p>

  • The written or electronic agreement between the Provider (Motoshare.ro) and the owner of the motorcycle offered for rent through the rental service provided by the Motoshare.ro website.<\/li>
  • The written or electronic agreement between the Provider (Motoshare.ro) and the client who rents a motorcycle through the Motoshare.ro website, which grants the right to use the motorcycle for a specified period and under the agreed conditions.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

    1. Please read these Terms and Conditions carefully before using the Website or any of our services. Your use of the Website constitutes your acceptance and agreement to be bound by these Terms and Conditions. By placing an order for services provided by SC Laredo on the motoshare.ro Website, you agree to be bound by the Terms and Conditions. And even if you do not purchase any services from the Company, you will still need to comply with the Terms and Conditions in order to properly use the Website. If you do not agree to these Terms and Conditions, you must not use this Website or any service provided by the Company.<\/li>
    2. The company does not own a motorcycle fleet and does not provide motorcycle rental services itself, but mediates for these services to be provided by natural or legal persons who own motorcycles.<\/li>
    3. On the Website, the Company provides you with information about the available offers related to the Package Travel Services (including motorbike rental companies, motorbike types, locations, booking dates and times, rental terms, available tour guides and advisory services (if any), etc.).<\/li>
    4. By providing your personal and booking - listing data, by choosing one of the payment methods offered and by accepting the Terms and Conditions, you legally consent to accept the Company's offer to conclude a contract for the provision of Services for the use of the motoshare.ro platform (hereinafter referred to as the "Rental Contract") and become the Company's client (hereinafter referred to as the "Client" or "Owner").<\/li>
    5. Access to the website is permitted to any user for the purpose of listing a motorcycle for rent or making a reservation.<\/li>
    6. To rent a motorcycle, the Client must be at least\u00a021 years old<\/strong> and a valid driving license for the category A, A2, A1 or AM \u2013 <\/strong>related to the motorcycle \/ scooter classification class. A copy on the phone is not accepted, the presentation of the physical license is CoMPULSoRY<\/strong>.<\/li>
    7. The Provider reserves the right to refuse a booking or rental if the Client does not meet the legal requirements or the Provider\u2019s internal safety conditions.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

      Reservations and payments <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
      \n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t
      1. Bookings can be made online through the website or by phone.<\/li>
      2. Upon completing the reservation steps, the site will charge 15% of the total rental period value via online payment (bank card) or payment order.<\/li>
      3. The remaining payment of 85% will be collected by the owner upon return of the motorcycle. This payment can be made in agreement with the owner, in cash, by card or by bank transfer, depending on availability.\u00a0<\/li>
      4. Rental rates are displayed on the website and may be changed without prior notice; changes do not affect bookings that have already been confirmed.<\/li>
      5. For any rented motorcycle, a fee will be required. security deposit<\/strong>, amount displayed on the site next to the respective motorcycle, and which will be paid to the owner at the time of rental. He will receive this amount back representing security deposit<\/strong> if the rental went without any negative incidents and the motorcycle is in the condition in which it was picked up.<\/li>
      6. Payment is made via\u00a0bank card \/ bank transfer<\/span>, according to the available options.<\/li>
      7. Any bank fees or currency conversion charges are the responsibility of the Client.<\/li>
      8. All bank payments shall be made exclusively in RON.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

        Handover and return <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
        \n\t\t\t\t

        1. The motorcycle is handed over to the Client in good working condition, clean, and with a full tank of fuel.<\/li>
        2. The customer must ensure that all original documents below (copies or digital versions are not accepted) will be presented by the main driver upon pickup of the motorcycle: valid driving license<\/strong> in the name of the main driver in the main driver's country of residence. This must be valid in the country where the motorcycle is rented and\/or used; valid passport<\/strong> in the name of the main driver or identity card<\/strong> valid. A credit card<\/strong> valid or another card accepted according to the rental conditions of the motorbike rental company, in the same first and last name as the main driver's driving license, with sufficient available funds to cover the security deposit<\/li>
        3. When picking up the motorcycle, the owner may refuse to hand it over if the client is intoxicated, under the influence of psychoactive substances or drugs. Also, if the owner finds that the client's health condition is such that it endangers his\/her movement on the motorcycle or the client has a physical or mental disability that does not allow him\/her to drive the motorcycle safely, he\/she may refuse to rent it. In any of the above situations, the owner is obliged to notify the Motoshare.ro Company about this fact.<\/li>
        4. Upon handing over the motorcycle, a report will be drawn up that will certify the condition of the motorcycle, the number of km, and will indicate any possible bumps or damaged parts. Photos will be taken of the affected areas, photos that will be kept by both the owner and the customer.<\/li>
        5. The client is obliged to return the motorcycle on the agreed date and time, in the same condition, with a full fuel tank. Returning the motorcycle with less fuel in the tank obliges the client to pay for the fuel difference. Late return may incur additional costs according to the rates displayed or provided in the contract.<\/li>
        6. Any delay in handover will be notified as soon as possible to the owner and the Company. If the delay is more than 3 hours, a penalty of 10% will be charged for each hour of delay, from the cost of a day's rental. If the delay exceeds 8 hours, the penalty fee is the cost of 100% of a day's rental.<\/li>
        7. If, for any objective or not reason, the client does not notify the owner and the Company of a possible delay, the police will be notified and a declaration will be made. motorcycle theft<\/strong>. Most motorcycles have a built-in GPS location module and this data will be transmitted to the competent authorities.<\/li>
        8. At the time of return, the owner is obliged to inspect the motorcycle and sign the return report.<\/li>
        9. Any damage caused to the motorcycle during use is the responsibility of the client, except in cases covered by the insurance policy, but the security deposit may be partially or fully withheld depending on the severity of the damage. In the case of motorcycles rented without FULL CASCO insurance, any damage caused to the motorcycle will be negotiated directly with the owner, and Motoshare has no obligation to compensate the motorcycle owner or to intervene between the client and the owner.<\/li>
        10. Any repairs to the motorcycle shall be carried out only with the Owner\u2019s consent. In the event of an accident involving injuries, the Police must be notified.<\/li>
        11. For the loss of documents, a fee of 80 Euros will be charged.<\/li>
        12. For the loss of keys, a fee of 200 Euros will be charged.<\/li>
        13. The Company will not be liable for any waiting time or delays at the motorcycle owner's premises. Any such delays are the responsibility of the motorcycle owner and are not within the scope of the Company's obligations.<\/li>
        14. If, upon pick-up, the motorcycle offered by the owner does not correspond to the one reserved on the site or if the Client considers that the condition of the vehicle is not suitable for hitting the road, the Client must notify the motoshare.ro Customer Support team in order to fulfill their legal obligation to reduce the damages or to mediate for the replacement of the vehicle or the motorcycle owner who engaged in providing the Services for the travel package.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

          Client's rights and obligations <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
          \n\t\t\t\t
          \n\t\t\t\t\t\t\t\t\t
          1. To use the motorcycle in accordance with traffic laws and the instructions provided.<\/li>
          2. Not to sublet, sell, or otherwise transfer the motorcycle.<\/li>
          3. Must not participate in races, rallies, or competitions.<\/li>
          4. Must not exhibit aggressive behavior, ride on one wheel (wheelie), excessively rev the engine, or perform burnouts.<\/li>
          5. Must not ride off-road or through water (rivers, flooded areas), except for motorcycles for which special permission has been granted to ride in areas other than paved roads.<\/li>
          6. Must immediately notify Motoshare or the motorcycle owner in the event of incidents, malfunctions, or theft.<\/li>
          7. To bear the costs arising from fines or road charges.<\/li>
          8. Ensure nighttime parking in a secure place, protected from the elements (covered), off the roadway and ensure that the motorcycle can be parked at night without disturbing sidewalk traffic, access to garages, blocking other vehicles, etc.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

            Rights and obligations of the Provider \u2013 Owner <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
            \n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t
            1. To ensure the delivery of the motorcycle in proper technical condition and with the necessary documents.<\/li>
            2. The motorcycle offered for rent must have all documents up to date and valid: a valid technical inspection (ITP), valid compulsory liability insurance (RCA), and optional comprehensive insurance (CASCO).<\/li>
            3. To inform the Client about the rules of use and the procedures in case of an incident.<\/li>
            4. Not to interfere with the Client\u2019s use of the motorcycle, except in cases of force majeure.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t
              \n\t\t\t\t\n\t\t\t\t\t
              Liability and insurance <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
              \n\t\t\t\t
              \n\t\t\t\t\t\t\t\t\t
              1. The motorcycles are covered by mandatory third-party liability insurance (RCA) and, where applicable, comprehensive insurance (CASCO).<\/li>
              2. The Client is liable for any damage caused to the motorcycle, third parties, or property.<\/li>
              3. MOTOSHARE is not responsible for indirect damages or loss of income, regardless of their nature.<\/li>
              4. Injury or damage to the motorcycle rider in the event of an accident is not covered by insurance.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t
                \n\t\t\t\t\n\t\t\t\t\t
                Cancellation policy <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
                \n\t\t\t\t
                \n\t\t\t\t\t\t\t\t\t
                1. Reservations can be canceled free of charge at least 48 hours before the start of the reservation period (pick-up time).<\/li>
                2. Cancellations made less than 48 hours in advance will result in the forfeiture of the deposit.<\/li>
                3. Failure to show up will result in the cancellation of the reservation and forfeiture of the deposit.<\/li>
                4. If the motorcycle is picked up from the owner later or returned earlier than the pick-up and drop-off times indicated in the rental agreement, the customer will not be refunded any amount for unused rental hours or days.<\/li>
                5. If the Customer does not intend to pick up the motorcycle (even if there is no refund), they must notify the Company as soon as possible; otherwise, the Customer may be charged an additional no-show fee.<\/li>
                6. Cancellation of a reservation more than 48 hours before the start date of the reservation will be fully refunded, with a 2% fee retained, representing the bank\u2019s commission.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t
                  \n\t\t\t\t\n\t\t\t\t\t
                  Failure to attend <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t
                  \n\t\t\t\t
                  \n\t\t\t\t\t\t\t\t\t

                  If the Customer does not pick up the motorcycle at the confirmed time and date, it will be classified as FAILURE<\/strong>. Any of the following situations listed below are considered FAILURE<\/strong>:<\/p>

                  1. Failure to show up will result in the loss of the reservation and the amount paid for the reservation. In certain situations and only after discussion with the Company, it may return a percentage of the amount paid by the client provided that the damage caused to the motorcycle owner is also accepted by him.<\/li>
                  2. The Customer does not provide information to the Company about the cancellation of the reservation 48 hours before the pick-up time and the Customer does not arrive at the motorcycle pick-up location on time.<\/li>
                  3. The customer does not provide the necessary documentation to pick up the motorcycle<\/li>
                  4. The Customer failed the security, credit score or blacklist check conducted by the motorbike rental company upon pick-up and was refused the vehicle. The Company may not be aware of, and is not obligated to know, the Customer's credit score or blacklist status with any car\/motorbike rental company. The Customer acknowledges that it is their responsibility to ensure that their status does not affect their ability to complete their booking and the Company will not be held liable for any consequences arising from the Customer being blacklisted by any car\/motorbike rental company.<\/li>
                  5. The Customer will be denied the vehicle if they arrive at the pickup location under the influence of alcohol or drugs, exhibit excessive fatigue, health problems, or other conditions that compromise the Customer's ability to drive the vehicle safely.<\/li>
                  6. In cases where the no-show is caused by circumstances beyond the Customer\u2019s control (e.g. flight delays or cancellations), the Customer must inform the Company and the Motorcycle Owner as soon as they become aware of the delay. In such cases, the Company may, at its discretion, assist the Customer with scheduling an alternative pick-up time or location, provided that the Motorcycle Owner is also able to accept the new pick-up time in accordance with its internal policies. The Company is not liable if the Motorcycle Owner is unable to keep the Motorcycle due to its internal policies or availability constraints.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t

                    Taxes and fees <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

                    The commission for listing the motorcycle and the rental service is 15% of the total amount and is collected on the motoshare.ro website by card payment or payment order.<\/p>

                    1. The 15% commission is charged for each rental period.<\/li>
                    2. The company can negotiate the commission charged for listing motorcycles on the site based on performance and rental volume<\/li>
                    3. No payment made by the customer on the site is charged.<\/li>
                    4. The rental amounts will be collected by the owners on site, by cash, bank account or credit card, depending on availability.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t
                      \n\t\t\t\t\n\t\t\t\t\t
                      Data protection (GDPR) <\/div><\/span>\n\t\t\t\t\t\t\t\n\t\t\t<\/path><\/svg><\/span>\n\t\t\t<\/path><\/svg><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t

                      The Company, as a data controller, ensures that the personal data of the Clients are processed in accordance with the personal data protection requirements applicable in the European Union, including the General Data Protection Regulation 2016\/679. The Company ensures that the personal data of the Client will be processed in accordance with the purposes of the Company's data processing, within the framework of the Services requested by the Client. We process the Client's data:<\/p>

                      1. to provide the Package Travel Services. The Company has the right to process and send the personal data, contact information (full name, date of birth, telephone number and email address) and booking information provided by the Client to the owner of the motorcycle, in order to confirm the requested rental service included in the Package Travel Services;<\/li>
                      2. including the Customer's email address, to send the booking confirmation in the form of a Voucher, to inform the Customer of the balance of his Booking Credit and its expiry date and to inform the Customer of important changes to these Terms and Conditions or any other policies of the Company;<\/li>
                      3. including the Client's telephone number, which will be used by the Company to clarify questions regarding the reservation, if any arise;<\/li><\/ol>
